Contract

Offer   , Acceptance and considerations are the central doctrines upon which a contract is founded upon. In order for a contract   to be binding on the parties, there must be an intention   to create the contact   or there must be a consensus of mind to lead to contract.  Whenever there is a dispute between the parties as to terms of contract   , court   can not import its own terms into it. It shall   ascertain the intention of the parties from the terms   .     The Indian Contract Act, 1872 is one of the oldest legislation which is a product of English common law.  The Contract Act is nothing but an assimilation of common law principles which are codified and given a statutory recognition    Contract Act   deals extensively with formation of a contract,   competency for a  parties to enter into contracts   performance of contract, damages for breach of contact  .Indemnity and guarantee, law of agency , partnership and  sale of goods are  another types of contracts dealt with under the contract law it is known as specific contacts. Each of this area is governed by specific legislations. The specific relief Act, 1963 is another important legislation which provide for specific performance of the contracts.

Property

There are two types of property: real property and personal property. Most of the legal concepts and rules associated with both types of property are derived from English common law. Modern law has incorporated many of these concepts and rules into statutes, which define the types and rights of ownership in real and personal property. Personal property, also referred to as movable property, is anything other than land that can be the subject of ownership, including stocks, money, notes, patents, and copyrights, as well as intangible property.


Real Estate
Land, buildings, and things permanently attached to land and buildings. Also called realty and real property. Real estate is the modern term for land and anything that is permanently affixed to it. Fixtures include buildings, fences, and things attached to buildings, such as plumbing, heating, and light fixtures. Property that is not affixed is regarded as personal property. For example, furniture and draperies are items of personal property.
